These Terms of Service ("Terms") govern your use of the website operated by SplitWing LLC ("SplitWing," "we," "us," or "our") at splitwing.vip and any related services, surveys, forms, or communications provided by SplitWing.
By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.
About SplitWing
SplitWing LLC is a Houston-based company exploring the development of a charter flight broker platform. We are currently in a market research and discovery phase, collecting information from potential travelers to understand demand for direct charter routes from Houston to underserved destinations.
SplitWing does not currently operate flights, sell tickets, or provide air transportation services. All information collected through our surveys and communications is for market research and future service planning purposes.
If and when SplitWing launches operational services, those services will be governed by updated terms that will be provided to users at that time.
Broker Model Disclosure
SplitWing is designed to operate as a charter flight broker. SplitWing does not own, operate, or maintain aircraft. SplitWing does not hold an air carrier certificate and does not provide air transportation services.
Any future flight services facilitated through the SplitWing platform will be provided by independent FAA Part 135 certificated air carriers. All contracts for air transportation will be directly between the traveler and the certificated operator. SplitWing's role is limited to matching travelers with certificated operators and facilitating administrative coordination.
SplitWing does not exercise operational control over any flight, does not assign crew or aircraft, and does not make safety or operational determinations on behalf of any operator or traveler.
Cancellation and Refund Policy
SplitWing does not set, control, or determine cancellation or refund policies for any flight. All cancellation and refund terms are established by the FAA Part 135 certificated operator providing the air transportation.
If you cancel a booking, the operator's cancellation policy governs whether a refund is available, the amount of any refund, and the timeline for processing. SplitWing facilitates the refund process on behalf of the operator but does not have the authority to override, modify, or make exceptions to the operator's policy.
It is your responsibility to review and understand the operator's cancellation terms before confirming any booking. Cancellation terms will be provided to you prior to payment confirmation.
SplitWing's platform booking fee is non-refundable once a booking is confirmed, unless the flight is cancelled by the operator or does not depart for reasons outside of the traveler's control.
By confirming a booking through SplitWing, you acknowledge that cancellation and refund outcomes are determined solely by the certificated operator and that SplitWing is not the deciding party in any refund determination.
Surveys and Data Collection
By completing any SplitWing survey or form, you acknowledge that:
Your responses are voluntary and provided at your own discretion
Your responses will be used for market research, route planning, and future service development
Completing a survey does not constitute a booking, reservation, commitment, or obligation of any kind
SplitWing is not obligated to launch any specific route, service, or product based on survey responses
Your contact information will be used in accordance with our Privacy Policy
SMS Communications
By providing your phone number and opting in to receive text messages through any SplitWing form or survey, you consent to receive SMS messages from SplitWing LLC regarding flight route availability, service updates, and related communications.
You may opt out at any time by replying STOP to any message. Message and data rates may apply. Message frequency varies. Consent is not required to use our website or complete our surveys.

Intellectual Property
All content on the SplitWing website, including text, graphics, logos, images, and software, is the property of SplitWing LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
User Conduct
When using our website or communicating with SplitWing, you agree not to:
Provide false or misleading information in any survey, form, or communication
Use our website for any unlawful purpose
Attempt to gain unauthorized access to any part of our website or systems

SplitWing does not warrant that:

Any future services will be available on specific routes, dates, or at specific price points
Survey responses will result in the launch of any particular route or service
Limitation of Liability
To the maximum extent permitted by law, SplitWing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, surveys, or any communications with SplitWing.
SplitWing's total liability to you for any claim arising from your use of our website or services shall not exceed the amount you paid to SplitWing in the twelve months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless SplitWing LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of our website, your violation of these Terms, or your violation of any rights of a third party.
Governing Law
